1. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you ("User", "you", or "your") and AutoMoJapan ("AutoMoJapan", "we", "us", or "our"), governing your access to and use of our website, online services, and vehicle purchasing process.
By browsing our website, submitting an enquiry, placing a pre-order, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms in their entirety, together with our Privacy Policy and Cookie Policy.
2. Our Services
AutoMoJapan is Bangladesh's premier importer of Japanese vehicles. Our services include, but are not limited to:
- Sourcing, bidding, and procuring vehicles from Japanese auctions
- Providing verified auction sheet inspection and grading reports
- Facilitating the importation, customs clearance, and registration of vehicles in Bangladesh
- Offering pre-order and custom sourcing of vehicles
- Selling automotive accessories
- Arranging test drives for in-stock vehicles
We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.
3. Eligibility
To use our services or enter into a purchase agreement with AutoMoJapan, you must:
- Be at least 18 years of age.
- Be legally capable of entering into binding contracts.
- Provide accurate, current, and complete information during any registration or purchase process.
We reserve the right to refuse service to anyone for any reason at any time.
4. Vehicle Purchases & Orders
4.1 Order Process
All vehicle orders are subject to availability and final confirmation by AutoMoJapan. Placing a pre-order or paying a booking deposit does not guarantee delivery of a specific unit unless explicitly confirmed in writing by us.
4.2 Auction Bids
When you commission AutoMoJapan to bid at Japanese auctions on your behalf, your agreed maximum bid price is binding. We are not liable for winning bids that exceed your estimate due to live auction competition unless we have exceeded your authorised maximum.
4.3 Vehicle Condition
All vehicles are sourced and graded according to the Japanese Auction Sheet system. Auction grades are provided for information only and are the assessments of third-party graders — not a guarantee of condition by AutoMoJapan. Pre-shipment inspection reports (where available) take precedence.
4.4 Cancellations
Once a vehicle has been procured at auction or a purchase agreement has been signed, cancellations may not be possible or may attract a cancellation fee of up to 20% of the agreed vehicle price, to cover auction costs, transport, and administration charges already incurred.
5. Pricing & Payment
All prices displayed on our website are in Bangladeshi Taka (BDT) and are indicative only. Final pricing depends on:
- Prevailing exchange rates (JPY/BDT) at time of purchase
- Current auction hammer price
- Applicable import duties, taxes, and government levies
- Shipping and freight costs
- Port handling and customs clearance charges
A formal quotation will be provided before any order is confirmed. Payment terms, schedules, and accepted methods will be outlined in your purchase agreement. AutoMoJapan does not store payment card information.
6. Delivery & Import Process
Estimated delivery timelines provided are in good faith and subject to:
- Shipping schedules and vessel availability
- Weather and force majeure events
- Bangladesh customs processing times
- Government regulatory changes
AutoMoJapan shall not be held liable for delays arising from circumstances beyond our reasonable control. Title and risk in the vehicle passes to the buyer upon full payment clearance and vehicle release from our premises.
7. Warranties & Disclaimers
Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, AutoMoJapan disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability and fitness
- Accuracy or completeness of website content
- Uninterrupted or error-free operation of the website
Used vehicles are sold without any manufacturer's or dealer's warranty unless expressly stated in the purchase agreement. AutoMoJapan provides a 30-day mechanical inspection warranty on engine and transmission for in-stock vehicles sold from our Dhaka showroom, subject to the specific terms set out in your vehicle handover document.
8. Limitation of Liability
To the maximum extent permitted by law, AutoMoJapan, its directors, employees, agents, and affiliates shall not be liable for any:
- Indirect, incidental, or consequential damages
- Loss of profits or business opportunities
- Loss of data or goodwill
- Damages arising from reliance on auction sheet grades or vehicle descriptions provided by third-party graders
In any event, our maximum aggregate liability to you shall not exceed the total amount you have paid us in the six (6) months preceding the claim.
9. Intellectual Property
All content on the AutoMoJapan website — including text, photographs, graphics, logos, icons, and software — is the property of AutoMoJapan or its licensors and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Personal, non-commercial use for reference purposes is permitted.
10. Privacy
Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and processing of your personal data as described in the Privacy Policy.
11. Changes to Terms
We reserve the right to update or modify these Terms at any time at our sole discretion. We will indicate the date of the latest revision at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the new Terms.
For material changes, we will make reasonable efforts to notify registered users via email or a prominent notice on our website.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
